I'm not familiar with the picture. I'm assuming it's your vehicle from a magazine?
If that's the case, did you sign some kind of waiver giving up rights for the use of the picture?
-
Guys, I am removing the topic. Until I get some more info I don't think I should be discussing it. I need to do some research

I'm confused. ???

I deleted the first post in this thread. Here is the jist
Ok, today I was sent a pic of a t-shirt. No big deal right? Well..................... The pic on the shirt was my Zuk. A company used my pic (my property) to comercially print and sell shirts without permission to use the pic. I called them and they are freaked out. They said that someone sent them the pic and claimed that it was theirs blah, blah, blah. So they are kinda freaked out by the whole ordeal. To add to it, the pic in question is also copyrighted by a Suzuki vendor in a magazine ad they are going to run soon. Anyways, they are working on a resolution. I hope they give me a billion dollars. Then I can buy Zuks for EVERYONE!! Wel, that's not true butthey want to fix the problem. More info to come

FYI: I dont know if it was out of common courtisy or out of legal obligations, but both Calmini and Rocky Road asked my permission before using a pic of my ride on their web site. I did not even take the pic, and they still asked me if they could use it.
-
It is out of legal obligation that they asked to ues it. To be honest they need the photographers permission and not yours if it was on a public trail where anyone can take the pic. But if it is your pic, a friends pic they need permission to use it. I have been doing some searching and believe it or not they will actually owe me a settlement of sort. Whatever we work out between us or I could actually get a lawyer. I don't want the second part. I just want them to make things right.

Yea, I dont blame you. I got realy mad when I saw a pic of my Kick in Truck Worlds Readers rides and someone was claiming it as their own >:( The bad part is I let them (TW) know and asked for it to be removed and it is still up there >:(.
My pic was taken by someone else on a private club ride our club was putting on (on private land). The photographer was suprised at how well it turned out and sent it to me. I did ask him, and he said I could have it to use as I wanted ;D
I hope everything works out. Keep us updated.

PS. Hope that this #^%& Rain does not end up over there. Forgranted it's not a hurricane, but these winds and rain are going to make my 100 mile commute tough this afternoon :o

The guy is even using my truck as his summary pic, so when you look through the list of sidekicks, you'll end up seeing my summary pic twice in 3 pages.
It's not such a big deal, it's nice having a compliment like that, but he didn't ask me.

Well I talked to the owners again today. They admitted that they just took it off of the Shrockworks website without asking for permission. :o Basically they admitted to stealing it. What really bugs me is that they said that they don't know what to do about it. I asked them to make me an offer to reconcile. Just so you know I spoke to some design/advertising guys today. They said that in order to use a pic they need rights to do so. Based on the pic he would put it in a catagory of "limited rights usage" That means they pay to use the pic for a prescribed time or prescribed number of prints. He said a pic like the one they used (mine) would cost between 1000 and 6-8,000 for rights to use it. I was amazed. I don't plan on legal action. I would just like to be compensated fairly since they sell the shirts for 16.50 each and cost about 4-5 bucks to make ::)

Well, it's done. We reached a settlement that I can live with. ;D ;D ;D Oh, I got them to donate to the upcoming Zuwharrie Raffle as well ;)

The main reason I got so craped off was he was listing alot of mods and future mods that I would never do to my Kick.
