Help! What to keep??
« on: March 01, 2004, 02:38:53 AM »
Well After more than 5 years of Marriage my wife is moving out this weekend. One of the biggest problems is What vehicle do I get and What does she get?

See we have a 2001 XL-7 and a 94 4dr kick. She doesn't want the kick and doesn't want the payment on the XL-7. Another concern is I just started lkifting the kick. I don't know what to do.

She also wants to leave me with all the debt, the house plus we have 3 children and 2 dogs to figure out too. This just completely sucks! I have been totally faithful and commited to her for almost 9 years now and it feel like my whole world is imploding.

Any advise would surely help.

Thanks,
Jeff

Three Words, Get a GOOD Lawyer!!! Most weomen assume that the man will be responsible for all the debt. In todays world it is just as likely for her to be paying you for child support. In the case of her leaving her faithfull husband of 9 years, you can not only keep from getting screwed over, you can get whats right. I have seen to many guys during an emotional period like this, throw their hands up and let their soon to be X have their way, just to get it over with. I'm sorry to hear about your troubles and hope it all goes as good a possible.

Take a step back and slow things down a little and do whatever you can to save your marriage!

I just got back from a familylife marriage conference this weekend in Allentown. This conference can save your marriage!  It will totally change the way you look at marriage and each other and provide the tools and resources to help you get through what you are up against.

http://www.familylife.com/marriage.asp
Here is a link to the marriage page on the website, you can get info on conferences, reading materials and help from counselors and others going through the same thing you are.

You missed the PA conferences, but there are conferences coming up in Ohio and NY, I think the one in Ohio is later this month.  We sponsored another couple to go and if you are interested (and your wife is willing) I will sponsor you and her to go.  It could save your family, please think seriously about it. I'll have you guys in my thoughts and prayers.

Sorry to hear that.  Im with zukipilot get a good lawyer.  As for xl-7 you more than likely still have payments on it and if you sell it you might take a bath on it.  It a hard call  but its turley last on the list of what you need to be thinking about.
Oh ya if PA is like NJ let her file for it or you will end up paying for it.

Sorry to hear about what's happening but if you're sure it's over then get the meanest attorney you can afford. I have a friend going through the same situation and she started out wanting nothing, now she wants everything and wants him to pay for it. Take nothing for granted and seek professional help as fast as you can get to it. Good Luck!

Aint no way Id pay for a car I wasnt using!!! Id set that fucker on fire.

If she happens to make more money than you, you should be able to get support from her if you get shared parenting. It sucks to have kids involved, but you can file for temporary custody until the divorce is final. You have to file for custody before she does in order to get it.

Later,
Bill

JEFF, DEFINATELY SIT BACK AND THINK BEFORE YOU ACT...AND IF YOU HAVE TRIED ALL AVENUES TO SAVE WHAT YOU HAD TOGETHER.....AND REMEMBER WOMAN LOVE TO GET YOU TO DO OR SAY SOMETHING THAT SHE CAN USE AGAINST YOU....I'M THINKING THAT MAYBE THIS IS THE FINAL STEP CAUSE ITS BEEN ONGOING A BIT  I THINK YOU MENTIONED BEFORE...SO DO GET A LAWYER AND LET HIM DO ALL THE SPEAKING FOR YOU....GOOD LUCK HOPE ALL IS BETTER SOON.......MATTY D.  8)

Oh Yea, Also don't let the lawyers do a, she keeps the house/car/whatever, and a loan still have you name on it!!!!!!! MAKE HER REFI OR SELL IT if she can not get the loan in her name only. No mater what the court doccuments say about ownership you will still be responsible for the loan you signed for. Therefore she can keep the house/car/whatever, use it till it's trash, quit paying on it and YOU will be held liable for the balance, have you credit trashed, etc....It happens all the time in divorce situations and people assume that they are off the hook because the papers say the item is now the responcilibity of the other party, but that is not true unless you spend LOTS of $'s sueing her for compensation and that still can not fix your credit >:(

And while we're at it get a paternity test on the kids... just in case. Too many guys end up paying for years for kids they find out ain't theirs.....

If you can do things amicably, do so now and get a lawyer to certify it.... make sure that you both agree and both parties have their own lawyer to ratify it.

If not, bring the lawyer in early... nothing worse than bringing a spoon to a knife fight... Being nice doesn't pay when someone's trying to screw you..............

If she's walked out that will help your case, but family courts are usually much more generous to the women.

just make sure that if she walks out with half the assets, she walks out with half the debt too - and assets and debts are moved into the appropriate person's hands.

If she doesnt want the debt of the XL 7 sell it.... now before she gets the asset and you get the debt.

Then she can try and sue you for half the profit, not half the new purchase price so you wear half the new car and the monty you've already lost in depreciation.

Living in major debt for the next 20 years while she runs off for an easy life with the next bloke on your money is a real b1atch.

Oh.... one more thing..... don't let her have the dog.... let her have the kids, the money, or the car, but don't let her have the dog.

You can always trust the dog to love and respect you..........
